These Terms of Service ("Terms") govern your access to and use of the ClaimLogic website and services (the "Service"). By accessing or using the Service, you agree to be bound by these Terms. If you do not agree, do not use the Service.
By accessing, browsing, registering for, or using the Service in any way, you agree to be bound by these Terms and our Privacy Policy. You represent that you are at least 18 years of age and have the legal capacity to enter into a binding agreement.
ClaimLogic provides AI-assisted analysis of insurance-related documents (including but not limited to engineer reports, insurance policies, and supporting documentation). The Service generates informational output intended for use by licensed professionals in connection with insurance claims and related matters.
The Service is an informational tool only. ClaimLogic is not a law firm, public adjusting firm, engineering firm, restoration contractor, or other licensed professional, and does not provide legal, adjusting, engineering, or contracting services.
By using the Service, you represent and warrant that:
Output produced by the Service does not constitute legal advice, an insurance adjustment opinion, an engineering opinion, or a contractor's scope of repair. Use of the Service does not create an attorney-client, adjuster-insured, engineer-client, or contractor-client relationship between you and ClaimLogic.
You are solely responsible for the use of any output, including determining whether the output is accurate, appropriate, and lawful for your intended use.
Certain features of the Service require payment. Fees are charged at the time of order and processed through Stripe. All sales are final once the analysis has been generated. Refund requests may be considered on a case-by-case basis at ClaimLogic's sole discretion, including in cases of technical failure that prevented delivery of the requested analysis.
The Service, including all software, design, text, graphics, logos, and other content (excluding User Content), is owned by or licensed to ClaimLogic and is protected by copyright, trademark, and other intellectual property laws.
You retain ownership of any documents you upload ("User Content"). You grant ClaimLogic a limited, non-exclusive, royalty-free license to use User Content solely to provide the Service to you. ClaimLogic does not claim ownership of User Content.
You retain ownership of analysis output generated for you, subject to ClaimLogic's underlying intellectual property in the system and templates.
Your use of the Service is also governed by our Privacy Policy. ClaimLogic takes reasonable measures to protect User Content but cannot guarantee absolute security. You should not upload documents containing information you are not authorized to share.
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, ACCURACY, RELIABILITY, OR UNINTERRUPTED OPERATION. CLAIMLOGIC DOES NOT WARRANT THAT THE OUTPUT WILL BE ACCURATE, COMPLETE, ERROR-FREE, OR SUITABLE FOR ANY PARTICULAR USE.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, IN NO EVENT SHALL CLAIMLOGIC, ITS OPERATORS, AFFILIATES, OR LICENSORS BE LIABLE FOR ANY DIRECT, INDIRECT, INCIDENTAL, CONSEQUENTIAL, SPECIAL, EXEMPLARY, OR PUNITIVE DAMAGES ARISING OUT OF OR RELATING TO YOUR USE OF, OR INABILITY TO USE, THE SERVICE OR ANY OUTPUT PROVIDED THROUGH IT, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
CLAIMLOGIC'S TOTAL CUMULATIVE LIABILITY ARISING OUT OF OR RELATING TO THESE TERMS OR THE SERVICE SHALL NOT EXCEED THE TOTAL AMOUNT YOU PAID TO CLAIMLOGIC IN THE TWELVE (12) MONTHS PRECEDING THE EVENT GIVING RISE TO THE CLAIM, OR ONE HUNDRED DOLLARS ($100), WHICHEVER IS GREATER.
You agree to defend, indemnify, and hold harmless ClaimLogic, its operators, affiliates, licensors, and their respective officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, costs, or expenses (including reasonable attorneys' fees) arising out of or relating to: (a) your use of the Service; (b) your violation of these Terms; (c) your violation of any law or the rights of any third party (including UPL or UPPA violations); or (d) your use of, or reliance on, any output produced by the Service.
ClaimLogic may suspend or terminate your access to the Service at any time, with or without notice, for any reason, including violation of these Terms. You may stop using the Service at any time.
These Terms are governed by the laws of the State of Florida, without regard to conflict-of-laws principles. Any dispute arising out of or relating to these Terms or the Service shall be brought exclusively in the state or federal courts located in Florida, and you consent to the personal jurisdiction of such courts.
ClaimLogic may update these Terms from time to time. Material changes will be posted on this page with an updated "Last updated" date. Your continued use of the Service after such changes constitutes acceptance of the revised Terms.
